アネモイ合同会社（以下「当社」）は、当社が運営するToyFuKu（以下「当店」）のECサイトおよび関連サービス（以下「本サービス」）の利用条件を以下のとおり定めます。
1. 適用
本規約は、本サービスを利用するすべてのお客様（以下「ユーザー」）に適用されます。ユーザーは、本規約および当社が本サービス上で表示する各種ルール・ガイドライン（ポイントプログラム規約、プライバシーポリシー、配送ポリシー、返品・返金ポリシー、特定商取引法に基づく表記、各商品ページの個別条件を含みます）に同意のうえ本サービスを利用するものとします。個別の特約や各商品ページの個別条件がある場合は、当該特約・条件が本規約に優先します。18歳未満の方は、保護者の同意を得たうえでご利用ください。
2. 取扱商品・表示
商品画像・色味・仕様・寸法・重量等は、表示環境や個体差等により実物と異なる場合があります。価格、在庫状況、仕様、販売条件は予告なく変更されることがあります。商品価格、送料、手数料、割引等の最終的な適用内容は、カート画面・チェックアウト画面に表示される内容が適用されます。
3. アカウント
会員登録を行う場合、登録情報は真実かつ正確に維持してください。ログイン情報の管理はユーザーの責任とし、第三者による不正利用について当社は責任を負いません（当社の故意または重過失を除く）。当社は、合理的な理由がある場合、アカウントの利用制限・停止または削除を行うことがあります。ゲスト購入の場合も本規約が適用されます。
4. 申込み・契約成立
(1) 注文手続完了は申込みであり、自動配信の受付メールは受領通知であって契約成立を意味しません。
(2) 当社が出荷完了メールを送信した時点（または発送手配完了時点）で売買契約が成立します。品切れ、誤表示、与信否決、不正利用の疑い、数量制限超過、その他合理的理由により、注文をお断りまたは取消す場合があります。
(3) ご注文完了後6時間を経過した後は、契約成立の前後を問わず、お客様のご都合によるキャンセルはお受けできません（第8条(6)）。
5. 支払方法
当社は、Shopify Paymentsを含む当社が指定する決済手段（例：クレジットカード、Apple Pay、Google Pay、Shop Pay、PayPal、PayPay、メルペイ、d払い、あと払い（ペイディ）、au PAY、楽天ペイ、コンビニ決済等）をご利用いただけます（利用可能な決済手段はチェックアウト画面に表示されます）。与信審査の結果等によりご利用いただけない場合があります。金融機関の手数料等が発生する場合はユーザー負担です。
6. 送料・手数料
送料・手数料は、商品ページまたはカート画面・チェックアウト画面に表示される金額が適用されます。原則として、送料は以下のとおりです。
- ご注文金額が5,000円（税込）以上の場合：送料無料
- ご注文金額が5,000円（税込）未満の場合
- メール便（ポスト投函）：全国一律 150円（税込）
- 宅急便コンパクト（専用BOX）：全国一律 480円（税込）
- 通常配送（宅急便など）：全国一律 680円（税込）
配送方法は、商品のサイズ・形状・数量、お届け先の地域等により当社が決定します。適用される送料はご注文手続き画面に表示されます。詳細は「配送ポリシー」をご確認ください。
なお、発送後の保管料・再配達費用等が発生する場合はユーザー負担となることがあります。
7. 引渡時期・配送
決済手続完了後、原則として当社が定める期間内に発送します（目安：3営業日以内）。天候・交通事情・災害・繁忙期・システム障害等により遅延する場合があります。お届け先は、日本国内および当社が別途定める国・地域に限ります。配達完了をもって引渡完了とします。なお、配送方法、送料およびメール便の利用条件等の詳細については、別途定める「配送ポリシー」に準じます。
8. 返品・交換・キャンセル
返品・返金・交換・キャンセルの条件は、原則として当店の「返品・返金ポリシー」に従います。本項と「返品・返金ポリシー」の内容が矛盾する場合は、「返品・返金ポリシー」が優先します。概要は以下のとおりです。
(1) 初期不良・発送商品の間違い等（当店原因）：商品到着後7日以内に、マイページの「返品ボタン」よりご申請ください。当店負担で交換（在庫がない場合は返金）等の対応を行います。
(2) 返品送料無料キャンペーン（税込10,000円以上のご注文）：商品到着後7日以内に、マイページの「返品ボタン」よりご申請ください。試着後でもご返品いただけます。返送にかかる送料は当店が負担します。ただし、試着等により商品に破損・汚損が生じた場合はご返品をお受けできません。
(3) お客様都合の返品（税込10,000円未満のご注文）：商品到着後7日以内に、マイページの「返品ボタン」よりご申請ください。未開封・未使用で、付属品・タグ・袋・ノベルティを含め購入時の状態が完全である場合に限り受付します。返送送料はユーザー負担です。
(4) 返金対象額：お客様都合の返品において、返金対象となるのは商品代金のみです。ご注文時にお支払いいただいた往路送料は返金対象外です。
(5) 返品不可商品：カスタム・受注生産品（予約商品を含む）、商品ページに「返品不可」と明記のある商品、衛生上再販が困難な状態の商品は、お客様都合による返品をお受けできません。
(6) キャンセル：ご注文完了後6時間以内に限り、お客様のご都合によるキャンセルを承ります（予約商品・受注生産品を含め、すべてのご注文に適用されます）。6時間を経過した後は、発送準備に入るためキャンセルをお受けできません。この場合は、上記(2)または(3)の返品手続をご利用ください。

9. 禁止事項
ユーザーは、法令・本規約違反、虚偽登録、なりすまし、知的財産権侵害、当店または第三者に迷惑・不利益・損害を与える行為、過度な負荷、ボット等による不正購入、転売目的の大量購入、ポイント・クーポン等の不正取得/不正利用、その他当社が不適切と判断する行為をしてはなりません。
10. 知的財産権
本サービスに関する画像、テキスト、ロゴ、デザイン、プログラム等の権利は当社または権利者に帰属します。私的使用の範囲を超える無断の複製・転載・改変・配布を禁止します。
11. 保証・サービス提供停止
当社は、本サービスが常に利用可能であること、エラーがないこと等を保証するものではありません。保守・障害・天災・行政要請・第三者サービス（Shopify等）の停止・変更等により、本サービスの全部または一部を予告なく中断・変更・終了することがあります。これにより生じた損害について、当社の故意または重過失がある場合を除き、責任を負いません。
12. 免責・責任の限定
(1) 当社の故意または重過失による損害については、本条の免責・責任の限定は適用されません。
(2) 生命または身体の侵害による損害については、本条の免責・責任の限定は適用されません。
(3) 前2項以外の場合、当社の責任は、ユーザーが当該ご注文についてお支払いいただいた金額（送料を含みます）を上限とします。また、間接損害・特別損害・逸失利益等については賠償責任を負いません。
(4) 端末・回線・ブラウザ等の環境に起因する不具合について、当社は責任を負いません。
(5) 本条の定めは、消費者契約法その他の法令により免責・制限が認められない場合には適用されません。
13. 反社会的勢力の排除
ユーザーは、反社会的勢力に該当せず、関与・助長しないことを表明・保証します。違反が判明した場合、当社は催告なく契約を解除できます。
14. 個人情報の取扱い
当社による個人情報の取扱いは、当社のプライバシーポリシー（クッキー／解析・広告タグを含む）によります。ユーザーは同ポリシーを確認のうえ本サービスを利用するものとします。
15. 規約の変更
当社は、法令に従い、ユーザーの一般の利益に適合する変更またはやむを得ない事由による変更を行う場合、事前告知のうえ本規約を変更できます。変更後の規約は、当社サイト上での掲示時から効力を生じます。
16. 連絡方法
当社からの通知は、サイト掲示、登録メールアドレスへの送信等の方法で行います。メールは送信時点で到達したものとみなします（明白な配信失敗を除く）。ユーザーは受信可能な設定を維持してください。
17. 準拠法・合意管轄
本規約は日本法に準拠します。本サービスに関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、消費者契約に関する紛争については、法令によりユーザーに認められる裁判管轄を妨げるものではありません。
18. 譲渡禁止・分離可能性
ユーザーは、本規約上の地位または権利義務を第三者に譲渡・承継できません。本規約の一部が無効となっても、残余部分は継続して有効に存続します。

Terms of Service

Anemoi LLC ("we", "our", "us") sets forth these Terms of Service ("Terms") for ToyFuKu (the "Store") and our e-commerce site and related services (the "Service").
1. Scope & Acceptance
These Terms apply to all users of the Service. By using the Service, you agree to these Terms and any rules/guidelines displayed on the Service (including the Points Program terms, Privacy Policy, Shipping Policy, Return/Refund Policy, Legal Disclosures under the Specified Commercial Transactions Act, and any product-page specific terms). Any specific terms stated on product pages or special terms will prevail over these Terms to the extent of any inconsistency. If you are under 18, please use the Service with the consent of a parent or guardian.
2. Products & Display
Product images, colors, specifications, dimensions, weights, etc. may differ from actual items due to display environments or individual variations. Prices, stock status, specifications, and sales conditions may change without notice. The final applicable price, shipping fees, charges, discounts, and other terms are as displayed in the cart and at checkout.
3. Accounts
If you register an account, you must maintain accurate and up-to-date information. You are responsible for safeguarding your login credentials. We are not liable for unauthorized use unless caused by our willful misconduct or gross negligence. We may restrict, suspend, or delete an account for reasonable grounds. These Terms also apply to guest checkouts.
4. Orders & Contract Formation
(1) Completing checkout constitutes an offer; the automated order-received email is an acknowledgment only, not acceptance.
(2) A sales contract is formed when we send a shipping confirmation email (or upon completion of shipping arrangements). We may refuse or cancel orders due to out-of-stock, errors, failed authorization, suspected fraud, quantity-limit violations, or other reasonable grounds.
(3) Once 6 hours have passed after your order is placed, cancellations for your own convenience cannot be accepted, whether or not the contract has been formed (see Section 8(6)).
5. Payment Methods
Payments may be made via the methods we designate (including Shopify Payments and, where available, credit cards, Apple Pay, Google Pay, Shop Pay, PayPal, PayPay, Merpay, d Payment (d払い), Paidy (BNPL), au PAY, Rakuten Pay, Convenience Store Settlement, etc.), as shown at checkout. Use may be declined based on authorization results or other checks. Bank or payment-related fees, if any, are borne by the user.
6. Shipping Fees
Shipping fees and charges are as displayed on product pages and/or in the cart and at checkout. As a general rule, shipping is as follows:
- Orders of JPY 5,000 (tax-incl.) or more: Free shipping
- Orders below JPY 5,000 (tax-incl.):
- Mail Delivery (delivered to your mailbox): JPY 150 (tax-incl.) nationwide
- Compact Courier Delivery (dedicated box): JPY 480 (tax-incl.) nationwide
- Standard Shipping (courier): JPY 680 (tax-incl.) nationwide
We determine the delivery method based on the size, shape and quantity of the items, the destination area and similar factors. The applicable shipping fee is displayed during checkout. Please see our Shipping Policy for details.
Please note that additional fees (e.g., storage/redelivery fees after shipment) may be charged to the user where applicable.
7. Delivery
We generally ship within the period we specify after payment processing (guideline: within 3 business days). Delays may occur due to weather, traffic, disasters, peak periods, or system issues. Delivery is limited to Japan and to any other countries or regions we separately designate. Delivery is deemed completed when the carrier confirms delivery. Details regarding shipping methods, costs, and terms (including mail delivery) are governed by our separate Shipping Policy.
8. Returns, Exchanges & Cancellations
Returns, refunds, exchanges, and cancellations are governed primarily by our Return/Refund Policy. If there is any inconsistency between this section and the Return/Refund Policy, the Return/Refund Policy will prevail. A summary is as follows:
(1) Defective or wrong items (our fault): Submit a request within 7 days of delivery using the "Return" button in your account page. We will provide a replacement (or a refund if out of stock) and cover applicable shipping costs.
(2) Free Return Shipping Campaign (orders of JPY 10,000 or more, tax-incl.): Submit a request within 7 days of delivery using the "Return" button in your account page. You may try items on and still return them, and we cover the return shipping cost. However, items that are damaged or soiled during try-on are not eligible for return.
(3) Change-of-mind returns (orders under JPY 10,000, tax-incl.): Submit a request within 7 days of delivery using the "Return" button in your account page. Accepted only if items are unopened and unused and complete with all accessories, tags, polybags and freebies in original condition. Return shipping is borne by the user.
(4) Refundable amount: For change-of-mind returns, only the product price is refundable. Outbound shipping fees paid at the time of order are non-refundable.
(5) Non-returnable items: Custom and made-to-order items (including pre-orders), items marked as non-returnable on the product page, and items unhygienic for resale are not eligible for change-of-mind returns.
(6) Cancellation: Cancellations for your own convenience are accepted only within 6 hours of placing your order. This applies to all orders, including pre-orders and made-to-order items. After 6 hours we begin shipping preparation and cancellations can no longer be accepted; please use the return procedures in (2) or (3) above instead.

9. Prohibited Conduct
Prohibited acts include violations of laws or these Terms, false registration, impersonation, IP infringement, causing nuisance or damage, excessive load on our systems, fraudulent purchases (e.g., bots), bulk purchases for resale, fraudulent earning/use of points/coupons, and any other conduct we deem inappropriate.
10. Intellectual Property
All IP rights in images, text, logos, designs, and software on the Service belong to us or our licensors. You may not reproduce, adapt, or distribute content beyond personal use without permission.
11. Warranty & Service Suspension
We do not warrant that the Service will always be available or error-free. We may suspend, change, or terminate all or part of the Service without notice due to maintenance, outages, force majeure, governmental requests, or third-party platform issues (e.g., Shopify). We are not liable for resulting damages except in cases of our willful misconduct or gross negligence.
12. Disclaimer & Limitation of Liability
(1) The disclaimers and limitations in this Section do not apply to damages caused by our willful misconduct or gross negligence.
(2) The disclaimers and limitations in this Section do not apply to damages arising from death or personal injury.
(3) Otherwise, our liability is limited to the amount you paid for the applicable order (including shipping fees), and we are not liable for indirect, special, or consequential damages (including lost profits).
(4) We are not responsible for issues arising from user environments (devices, networks, browsers, etc.).
(5) Nothing in this Section limits rights that cannot be disclaimed or limited under applicable laws (including the Consumer Contract Act of Japan).
13. Exclusion of Antisocial Forces
You represent and warrant that you are not, and will not be, affiliated with antisocial forces. We may terminate the contract immediately upon any breach.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy (including cookies, analytics, and advertising tags). Please review the Privacy Policy before using the Service.
15. Changes to Terms
We may modify these Terms in compliance with applicable laws, including where the changes are in the general interest of users or reasonably necessary. Revised Terms take effect upon posting on our site following prior notice.
16. Notices
We may notify you via postings on the site or emails to your registered address. Emails are deemed delivered when sent unless delivery failure is clearly indicated. Maintain settings that allow receipt.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for disputes arising from or related to the Service, provided that this does not limit any jurisdiction available to consumers under applicable law.
18. Assignment & Severability
You may not assign or transfer your status or rights/obligations under these Terms. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
